father's name on birth certificate


What is the name of your state? virginia

i am currently living in virginia. i just had a baby and was told by the hospital that since my ex husband was not my child's father, and my divorce wasn't final for 10 months, that i couldn't put my child's father's name on his birth certificate due to virginia laws. is this true because i'm hearing mixed things about this. i am now married to my child's biological father. my baby was born april 3,2003...my divorce was finalized april 7, 2003 and i got remarried april 19,2003. i had been separated (not legally) from my ex husband for almost a year when i got pregnant and knew before i was pregnant that i would not be back with my ex husband due to physical abuse from him.

Looking at date of your post, this reply may come too late. However, I suggest that you go to the Va. Code website.
It is fairly easy to search.

When you get there enter "birth certificate" in the window.
If you are not satisfied with what you find in that section.
Do another search from that home page and enter "adoption" in the window. It seems bizzare but adoption of the child by his
biological father might be the expeditious way to get the certificated changed. I am surprised that I have had not previous occasion to consider this issue.
