fathers rights if not involved in childrens lives

I am an Unweb Mother and share two Children with the same man. He has never been a father to them, only when coveniet for him. He also in 9 yrs. of separation ever even paid support. The Boys carry his family name. His family name is known as trouble in and out of prison. The boys have been looked down upon because of the name. and even not been allowed to school friends houses because of who their fatheris. I do not feel they should have to suffer for their fathers mistakes on top him not acting like a father. Can I give them my family name without his consent. because he selfish and willing to see what they have dealt with.

You can always petition the courts to have their name changed. The father would have to be notified and then, if he objects, respond. If he doesn't respond or responds affirmatively, you should be able to do it. You MIGHT still succeed if he responds...
