Question

filing a response when served


Do I need to file my response to the divorce papers in person...or can they be mailed in or taken in by someone else??? I live in California...can someone tell me please?

My response:

The responsive pleading and declarations can be filed in court by any of the methods you've mentioned - - as long as they get to the court, that's all that matters.

Make sure, however, that you pay your $197.00 filing fee, and make a couple of extra copies for "conforming" and to have them mailed back to you.

Then, serve one of the conformed copies to your spouse, and make sure you have someone fill out and sign the proof of service form, and have that filed with the court (no fee).

If I were you, I'd buy a book on "Divorce" from Barnes & Noble and follow the directions and instruction because you're going to need more information, and you'll have a ton more questions to ask without the book.
