i wanted to know 2 questions 1. if the father of my kids has a prison record and felony record and gets ssi can he get my kids in a seperation or divorce under 3 years old and girls 2.does he have a chance at it during a divorce

You asked the same question twice. But yes, there is always a chance either parent can gain custody.

The mere fact that he has been to prison does not, in itself, negate his rights as a father. However, the court looks as the entire situation of both parents and determines which parent would be the best to have custody.

If you are doing tricks and have a $400 a week heroin habit and your ex was in prison for tax evasion, then he would have a very good chance.

However, no matter who is awarded custody, the father still has visitation rights and without interference from you. The court will also determine what his rights should be and you will have to abide by the decision.
