My stepmother arranged and signed for my father's funeral, ordering an expensive casket and cars which totaled over $10,000 without first consulting me, the executrix. She used money out of their joint checking and saving account, She then received a death benefit of $7500, and also $255.00 from the Social Security death benefit. She was left a living estate until
her death, and decided 2 months after my father's death that
she wanted us to sell the house. However, she stayed in the
house until one week before closing. Now she wants me, and
my 4 siblings to pay for the funeral expenses. Should she have
moved out asap after turning down the living estate? Could I
as executrix charge her for 6 months rental? My lawyer is now
telling me, that the funeral expenses will probably come off the settlement . If my stepmother signed the funeral contract, is she not liable?
I have a law book which states, that a wife who has joint own-
ership of a checking and savings account, can use the half which
belonged to the deceased to pay for any debts, including funeral
expenses. Is this not true? I appreciate your input. nannybez
