What is the name of your state? nj
I'd to to get guardianship of a 12 year old. he's grandmother now has it. i have taken care of him for several years, he lives with me. the catch is he is on medicaid. if i take custody, will he still be able to be on medicaid? I make to much to qualify. he has had a kidney transplant and takes very expensive medicines. I don't think i can persue this if he'll lose it.

You don't mention who presently has custody of the child. The grandmother has legal custody? you have physical custody? Why is the grandmother allowing this? Where are the parents? If this was via loss of parental rights and the child was in foster care they would probably continue to provide the medicaid regardless of your situation. If this custody situation is simply due to an agreement with parents and grandmother then it might get more complicated because it would then probably be based on her income. You might try to seek a lawyer who offers a free consultation - usually call your local bar association and they can tell you either who offers a free consult or such. This lawyer can then tell you legally what route to handle this.

Child was taken away from mother because of neglect etc. Grandmother has custody/guardianship. Grandmother is lower income. Mother has since died and father can't take custody. Since my income is above the income level needed for SSI, I need to know if he will lose his medical coverage, if i take over guardianship. he takes very expensive medicines and goes to specialists and there is always the possibility of rejection.
