I just recently married. my husband was married before for eight years. and supposbly , had two sons. he has always taken care of the kids but he also has hads doubts about if they were his,but was afraid to get a test done. the kids is his world. the ex-wife is physco.she has tried to make the man life miserable since the divorce. he pay child support faithfully. he participate in just about every activity they participate in . he gets them on the weekends and holidays, also birthdays. yet she has tried to file child abuse charges against him. and tries her best to turn the kids away from him. he would never do anything to hurt the kids yet in still she still lets him get the kids. just recently he found out through doctors he ca not conceive children. everyone is telling us he still can't get a legal dna test done nor stop paying child support because he has took care of them all his life, so that still makes him the father. he just want to know the truth . he would still take care of the and treat them the same. because thats all the know. but he want to get her out the picture for good. with no more harassments. some one please give us some good advice!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! |
Since the children were born of a marriage, he is presumed to be the father and so is the legal father and thus the current orders for custody, child support and visitation.
In Arkansas, he can challenge paternity at any time, just because a doctor says he cannot have children today doesn't mean that he couldn't in the past. No one can say with certanity how a judge will rule in advance if there is a challenge to paternity. For that reason, he may want to consider options and not forget that it is the best interest of the children, not ongoing disharmony between the parents. I would suggest that before he takes any action to consult with an attorney, and consider getting a private DNA test during a time he has the children, so that he knows just where he stands and whether to challenge paternity this could mean an addiltional test but possibly less expensive in the future depending on the results. Once he knows paternity, he and the attorney can discuss the options.
