What is the name of your state (only U.S. law)? ohio my daughter is leaving her hub he has the group insurance she is unisurable do to a problem she had giving bith does he has to cary her on his group insurance she will be insurable in a year if nothing goes wrong

She can get a restraining order requiring him to continue her on his insurance until the final divorce. At which point she will be dropped.

The employer's plan will not allow her to stay on his group plan after divorce. She may be able to use COBRA for a bit.

Doesn't her employer have a plan she can opt into?

Yes, but she may not be able to afford it for long. She's better off (financially) getting onto her own plan through work. It's virtually always cheaper than COBRA.

But not always possible due to the pre-existing condition. COBRA is probably what is needed.
