Luckily Kentucky does not recognize common law marriage. However you may have problems with the government if you filed joint tax returns stating you were married as that would be fraud. Hence since you were not common law married to your ex then it does not impeded you being married to your husband.

Nothing stated by me should be taken as giving you legal advice or forming an attorney/client relationship. The devil is in the details after all.

It may not be a problem with the IRS either. If it would substantially change the outcome of the returns, and if the returns are less than 4 years old, it would be a problem. However, these days the difference between the two of them each filing singly, vs filing a joint return, could even work out in the government's favor.
