| | Help - URGENT - Florida/Mississippi Okay here is the issue, I have a friend, who lives in Mississippi, I currently live in Florida. She has been raped (or molested, (sexually offended)) by her brother, about 3 years ago. To this day she is still afraid of telling her parents because she is afraid the brother will hurt her. She is 15, and the brother is 17. The question is, when she turns 16, in the state of Mississippi, can she become legally emacipated from her parents, she has a job, and still goes to school. Now, I know she has to beable to be self sufficient, however is there a way that my mother can take her in, I'm 17. My mother said she would be more than willing to take her in at anytime. I am not to clear on the emancipation laws though. Do you need to be a Florida resident to be emancipated in Florida? Will this case go through? She is self sufficient, plus she has a grown adult on her side.... Her mother has also moved her around alot in the past year, she has missed probably about 30 days or more of school. She may even end up failing because of the absences. Will that be taken into consideration aswell? I guess what I'm trying to get at is, can she become legally emancipated? Will the court consider it? What are the chances? and last but not least, what age can she legally leave that house without having any problems.... Another question, (Please answer the above questions first), in Mississippi I read that the law states that your parents have legal custody over you untill you reach 21. If she were to "run-away" at 18 and come to Florida, and marry her spouse at 18 can her parents do anything to her? Thank you for your patience and PLEASE respond to this A.S.A.P. She needs to tell the cops today what happened.
Emancipation is the least of her worries.

| | Okay, she is planning on telling the police what happened, however if she were to become emancipated she would be out of this house hold, thus terminating her parents rights over her and furthermore would be less likely for any of this to continue. Emancipation is obviously not the least of her worries if she is able to become emanciapted and lose the worries of her brother and another year of failing the 9th grade. Can you please respond A.S.A.P. thank you again. Also, my question still stands, is a 16 year old able to become emanicipated with these actions taken against her? (Please view my first post to see the full set of questions. Thank you for your patience.)
