Hoiuse payment responsibility


What is the name of your state? arizona. I am going throught a divorce and my husband is rtelling me that I am 50 percent responsible for the house payment and if I cant make my part of it then he can have it taken off of the back end of things. I am rlally frustrated and trying not to do get into legal matters burt I wouldliek to know my rights. I make approx 10,000 a year and he makes almost 90,000 a year. Thanks What is the name of your state?

Who is living in the house? Generally that is the person responsible for making the mortgage payment.

In any case, in a divorce situation its generally a bad idea to take legal advice from your soon to be ex spouse. If you don't have an attorney, you need to get one, even if you have to borrow the money from somewhere.

Technically, the parties on the mortgage are equally responsible to the mortgage lender to make the payments, whether they leave the place vacant, rent in it, or themselves live there. The lender is not a party to any subsequent agreements and have the right to hold all borrowers liable.

However, the party with use and enjoyment of the property normally assumes a greater financial responsibility because their use of the house precludes a cash flow from a tenant.
