Home advice. Please help.


Florida- I don't know exactly where I should put this. I've lived with my boyfriend over a year. Recently while up in Ohio for the holidays we broke up. He put me on a plane back to Florida and took my key. My name is not on the lease of the apartment and his mom pays the rent but I get all my mail and bills sent there. I have ALL of my clothing and belongings in there. I have lived there full time with my pets and him for over a year. He doesn't get back for another week and I need at least some of my stuff. My friend(cop) said I can legally break a window because I'm locked out of my home, but I would rather just get a locksmith to open the door. Every time I say I'm going to get my stuff, he says he has people watching the house and if I go anywhere near the house I'm going to get sued. I don't plan on taking or destroying any of his things, Just what belongs to me. Can he sue me? Am I allowed to go get my belongings? Am I allowed to still live there even since its my home?

Have you tried to contact his mother to see if she will cooperate with helping you retrieve your belongings? Otherwise, you might contact the police and explain the situation and see if they would escort you and a locksmith to the home so that you can retrieve your belongings.

The ENTIRE reason we broke up was because of his mother. She hasn't liked me from the beginning and was the main reason we broke up. She is the one who started all the legal stuff.

Does your driver's license have that address on it? Again, I would discuss the problem with the police. He actually does not have the right to lock you out without going through proper eviction proceedings.

That's a good point about the DL. If OP's DL does have that address, she can use that as proof that she lives there. Unfortunately, the police might want to wait until the AM, because they'll want to check at the courthouse to make sure that an eviction hasn't been filed. One thing OP can try if the police want to wait, would be to ask them to contact the Sheriff's Dept. In FL once an eviction order has been signed, a copy is sent to the county Sheriff's dept.
