How can I get my ex- fiance out of my apartmentWhat is the name of your state? new jersey I was just wondering if anyone knows the laws regarding my situation? My ex- fiance and I lived together for 7 yrs (no common law in NJ) We split up aboat a year and a half ago. the lease is in my name it was a 3 yr lease. I left the apartment and told him that he could stay their until he found a place. I left my furiture and most of my personel belongings in the apartment I still have a key and my DL has that address as well as my mail still being sent to that address. I spoke to the landlord today and the apartment is still considered mine. The problem is, I recently called the ex and asked i I could come and pick up mail and some clothing and he told me that he threw out my clothes and personal belongings and that I was not welcome to come there I told him that i have furniture in the apartment and need to get it told me that nothing in the apartment belonged to me. The recent change in his behavior is becouse he has moved in his new girfriend and doesnt want me coming into my own apartmenT. His name is not on the lease and never has been. Although he did take over the rent while i was out f the apartment. But it was always the undertanding that he was to move out and i was to move back in when he found a place. | Your legal rights are to BOOT him OUT of YOUR apartment!!! If there is NO written contract between the two of you - then simply tell him that he HAS to leave - and if he doesn't leave, that you will call the police, and have him removed. I know that I wouldn't care what kind of verbal agreement that me and an ex had...I would simply take back what is mine. You need to get your apartment back! |

| Screw That! Go to the PD and say this man has hijacked your apartment and won't let you in. He has no legal right to be there! As far as items of personalty, I would say NOTHING is his and make the police escort his ass out. THEN, I would take all his crap and throw it outside. If you go back there and your personal items are gone, then file charges on him for theft. (Your landlord should have NOTHING to do with this except to verify that you and only you are named on that lease) Let the police help you. They will. | It may not be that easy - he likely has to be evicted.

| Hello all, Thank you for your replies Well today the landlaord called me and and i can only assume they spoke to an attorney or the police becouse they are singing a diiferent tune today now its i can come and get my things and take all my furniture etc. hmm i wnder what transpired overnight I will keep you posted. thanks again watergirlkt |
