What is the name of your state (only U.S. law)? CO

I've been wanting to hypenate my son's last name, but his father refuses. We were never married, and already in a long court battle. Do I need his consent or can I just do it on my own?

Assuming that mom wants to change the child's last name from hers to hyphenated...and that he is legally established as the father.
They are already in a long court battle. She will need his permission.
