How do I make a post nuptial agreement legal?


What is the name of your state? Pennsylvania

I owned some properties before I married and recently sold them (while married). I paid off my other mortgages and with the profit put it down on a new home. I have two childred from a previous marriage who I want to leave the house to and my husband has a son (who will get his mother's house). I wrote up a post nuptial agreement which my husband is giving up rights to the house (he has no problem with it). The house is the only issue. Do I need to list any other assets, etc in the agreement? We don't have issues with them.

I know that we have to sign the agreement notorized. Should I file it with the court? I would like too - even if I don't have too. How would I do that?

Each of y'all needs to get a lawyer.

Give your lawyer a complete and total list of all assets and liabilities.

Hubby does the same with his lawyer.

The lawyers give each other the list.

An agreement saying whatever y'all want it to say will be drawn up.

Both you and hubby sign it and it is notarized.

In some states, these agreements do not get rid of marital interests in real estate, so make sure your lawyer tells you if that is correct in your state.
