How To Get a New York Death Certificate By Court Order?What is the name of your state? NEW YORK If there is a New York family law attorney reading this message board, I need some advice on an estimated cost (attorney fees, court fees, miscellaneous fees) and how long it would take to get a court order to permit me to obtain a death certificate from the New York State Health Department. It is needed to do genealogical research to find surviving next-of-kin on person who has some unclaimed monies. Is it a relatively simple process that does not take longer than a few months? __________________ There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution). Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport! |

Once paid, it's usually just a week or two till you get it. $30 a copy, plus postage. They also used to have a surcharge for "expidited processing" but I don't know if it's still available. (I'm also assuming this isn't outside NYC where they have their own procedures, in which case see the above reply). If you still feel some need to start an Article 78 case, you're looking at filing fees of around $350 and maybe 6-8 weeks of time till you can get before a judge.

| I am NOT next of kin so that is why a court order is needed. Thank you for the clarification--now I have some idea of what to expect. |

So, if you are not the next-of-kin, what EXACTLY is your relationship to this issue??? You are not an attorney, so can't be representing the family. I guess the only remaining answer is... you are an 'unclaimed property troll' who goes and tries to find unclaimed property.... then somehow tries to scam/induce the individual or surviving family to agree to pay you an unnecessary 'finders fee' for the information that YOU got for free!! ![]()

I am NOT a troll, and believe me, the families are very happy when I notify them of estates worth over $100,000 that they would not have been aware of previously without my notification. This is NOT unclaimed property, Miss Know-It-All. YOU try doing a search for heirs and you will see how expensive the computer time and public records documentation is, and nobody works for free, not even you. Note to YOU ARE GUILTY--YOU read the portion of the NYS vital records website where it states that there is a time limit on genealogy records that can be only be requested during certain years.
