How Important Is Last Name?What is the name of your state?What is the name of your state? FL My husband had an affair and the other woman is pregnant. She does not want to give the child my husbands last name. I know she has that option, but what does it do to my husbands rights if he is not listed on the birth certificate and the child not given his name? Does it matter if paternity is proven? |

| Your husband still has rights even when the child does not have his last name. Wehn the child is born, he will need to petition the court to establish paternity via DNA.

| name and birth certificate don't really affect dad's rights, he needs to establish paternity first then request his visitation/custody arrangement/child support through the courts |
