Husband filed charges for forgery on wife

What is the name of your state (only U.S. law)? VA

After being married for 5 years to my husband and writing checks out of
his personal checking acct as well as using his credit cards, he filed charges the day after I left him for forging checks out of his account.
I've been writing checks out of his account for years and now all of a sudden when I leave him he files.
My question is: Wouldn't the judge look at the length of time that it was going on and question him as to why it took him so long to file?

Any advice would be greatly appreciated. Thanks in advance
