I have 2 different topic questions


I got pregnant before I met my exhusband. And had the baby a month after we married. I never put him on the birth cert. but I gave her his last name. 3 years(almost 4) have past and now we are in the process of a Divorce. Is he able to put his name on the birth cert. without my permission? He tells me he can since she has his lastname. But wouldn't that mean that anyone with the same lastname could?

My exhusband took most of the Marital asset from our marriage and sold the vehicle that was bought during the time of our marriage. Am I entitled to half of what he got for the vehicle?

He cannot just put his name on the birth certificate. He would most likely have to do a DNA test and the results would show he is not daddy. YOu would not be able to collect child support from him. And why should he have to support a child that is not his anyway?
As for the car you may be able to depending on where the money went.

I wasn't wanting Child Support from him. He was wanting to put his name on the birth cert. without my permission. And I was just wondering if he could.
It went in to a new vehicle for him.

That new vehicle is marital property so you are not going to get cash. However if he is YOUR EXHUSBAND and not your estranged husband then that should have been dealt with in the divorce proceedings. The other thing about the birth certificate, he can petition the court to have his name put on the birth certificate which would force you to petition for a DNA test due to him not being daddy. The court could order his name added. And depending on whether they determine him the psychological father that could happen.
