The law can be unfair sometimes! A big misconception of many is that when a child is born out of wed lock that the birth mother automatically has custody, NOT TRUE.
Unless you have court documentation stating that you are the custodial parent of your child, he (the father) has just as much right to the child as you do.
If you want to change this, you must file papers with the court, seeking sole custody of you child. And if he is a threat to you or your child, make sure you include that in your case. I would ask for supervised visitation, because it can be hard to prove him so unfit to where he cannot come around at all.
