i need help


What is the name of your state? north carolina
my childs biological father has never really been around, he hasn't seen my child in the last 3-4 yrs and he only calls mayb 2x yr. birthday and christmas.well now its birthday time he has called and finally my child has told him how he really feels, well needless to say the "dad" didn't like that and said that of course i put him up to it and etc.... well for 9 yrs i have been recieving child support and like i said he has hardly ever been in the picture. but i dont remember gettin anything in writting about my full custody. my ? is do i have legal full custody or can he just come anytime and get my child without my permission, if so what exactly are my rights compared ti the "dad" that is never around but**************************** but has every right to come in and out of my childds life whenever he pleases and there is nothing i can do about it?

The law can be unfair sometimes!


A big misconception of many is that when a child is born out of wed lock that the birth mother automatically has custody, NOT TRUE.

Unless you have court documentation stating that you are the custodial parent of your child, he (the father) has just as much right to the child as you do.


If you want to change this, you must file papers with the court, seeking sole custody of you child. And if he is a threat to you or your child, make sure you include that in your case. I would ask for supervised visitation, because it can be hard to prove him so unfit to where he cannot come around at all.
