IAAL Help Me!

Dear Liable,
Here's another twist to the saga. I received a notice in the mail from New York court that my ex-husband filed a petition...on his own. requesting custody of our daughter. We had agreed that he would skip this Easters visit in lieu of having her next Easter. You see he didn't want to go from one summer to the next without seeing her in between. We had agreed last summer on the change in visitation and the previous changes in the past had run smoothly. But since the child has been giving him a hard time on the phone about going he decides to file for custody. Remember I live in NC. Spoke with my lawyer in NY and he says he finds it hard to believe that NY could still claim jurisdiction. I agree. Child is 9 lived in NC 7 years. I have an appointment with my lawyer here in NC tomorrow at 5pm. What should I ask him to do? Can I request he go and file an immediate petition requesting NC to take jurisdiction pending a further hearing or what? I do not want to subject myself to NY court again. Please help me. Thanks ... Sounds like a very good question to ask your NC lawyer. Since you have a local attorney, you may as well get the "straight, and local, poop" from him.
