Question

i the cp has a paper that states.. the ncp must notify me
by may 1st,by certified mail, for his weeks of summer visitations/which is today/ and he didnt! so the question is
,do i have to send my son to texas this summer? whenever he decides to send that certified letter?

It depends.. if you said no and he did nothing then you keep the child for the summer with no legal worries. However, if you refuse, he can petition the court to force the issue. The judge will take many things into consideration but above all, what is in the best interests of the child. A judge may decide that your refusal is petty, slap him on the hand for not following orders and then order you to allow the summer visitation.

BY MAY 1ST??


i havent refused,he didnt mail me by the date it states,so i have made my own summer plans. what does your sentence mean? >>he can petition the court to force the issue<<
THE ISSUE IS THE JUDGE/COURT SET THIS,AND HE [ncp] IS THE ONE NOT FOLLOWING,SO YOUR SAYING JUST BECAUSE GUIDELINES SAYS TO {NOTIFY cp BY MAIL BY MAY 1ST} DOESNT MEAN ANYTHING, JUST THAT HE CAN MAIL ME LIKE JUNE IF HE WANTS AND [TELL] ME WHEN[HE CHOOSES] HIS SUMMER DATES,and i still have to send the child?

It means you can continue on as if there is no visitation this summer, you can make your plans and purchase tickets etc. These will not be changed.

However, I was stating that if he was to petition the courts for the summer visitation anyway, a judge will look at the best interest of the child. It is not the childs fault that he has screwed up so why should the child suffer. If they currently have a good relationship then there is a *chance* that a judge would allow some visitation around your current schedule in the best interests of the child.

I have no idea what this man is like as a father. If he is a good father, then you should allow some visitation anyway, regardless of the 1st May deadline.
