investigation

I filed for custody of my nephew whos living in my house , his mom calls says she wants him back but then never shows up or calls these next couple of weeks are going to be torure for us my question is do my lawyer or my self need to ask for an investigation or do they automatically do one . hes my great nephew and his bio mom has become quite unstable latley . i know i have to legal rights to keep him here if she ever does show up but im afraid for him
