The judge won't render a judgment!


What is the name of your state? Aabama

I have been divorced fo nearly 4 years. My ex has made a hobby out of defying the divorce decree. I took him to court in May of 202 on several different issues and the judge has not yet ruled. My ex is refusing to do as he agreed pertainig to housing for his children and he is refusing to help with our son's college tuition. Because there has been no ruing I have had to carry the full burden of our son's colleg expenses plus we have had to live in limbo regarding the housing issue. The judge who heard our case left office in January and took over as the District Attorney. I have been told that he has ruled on all but 3 of his cases. Mine and 2 others are foating around out there somewhere. My attorney tells me that he doesn't know if the judge will ever rule or whether he is required by law to make a ruling. My question is this....Is there anything I can do to protect myself and my children? Are we at the mercy of this judge and have no choice but to pray and hope that he one day makes a ruling on the matter? Do I have any legal recourse against a judge who decides that our lives are not worthy of a speedy trial and verdict?

Since no one has responded I am going to assume that no one knows the answers to my questions. I have done some research this morning and have learned a few things. I am posting what I have learned in hopes that if anyone in the future comes to this board with the same problem they will be able to get some guidance from it.

The Alabama Judicial Inquiry Committee can take disciplinary action against a judge who fails to rule on a case in a timely manner. According to their website a judge is supposed to "diligently dispose, promptly with the business of the courts." If he has not ruled on a matter within 6 months then he is to turn the list of cases he has not ruled on over to the Administrative Office of The Courts with a reason as to why he has not ruled.

So, if you are in a situation where a judge is not ruling you can turn to your states Judicial Inquiry Committee for help and you can also call your states Administrative Office of The Courts and try to find out a reason.

If you have an attorney who is unwilling to do these things for you and act in a way that garners your trust you can chalk it up to him being a bad lawyer and work at finding yourself a new one.
