legal action against spouse


What is the name of your state? South Carolina

A wife has "confiscated" a jointly owned vehicle claiming it was abandoned by the husband. He is a long distance truckdriver and leaves the vehicle at his place of employment for transportation to and from work when he returns home. She phoned the husband's employer to ask if she could come and get the vehicle - the employer called the husband to ask his permission and the husband replied "no." She removed the vehicle during the night and has hidden the vehicle and is not allowing the husband access to it until he removes her name from the vehicle loan documents. But she will not allow him to inspect the vehicle for any damages prior to the visit to the loan office. Does the husband have any legal recourse?

It depends on HOW her name is listed on the title. Is it AND or OR between the names?

Thank you for your reply. On the loan documents, there appears neither an AND or an OR. It is simply the husbands name on one line and the wife's name on the second line. But on the vehicle registration from the DMV, it is listed as husband OR wife.

Then EITHER you OR your Wife can drive the vehicle. If you can't find out where it is and get it back, then she can legally either drive the vehicle.
