Legal Marriage or not?


What is the name of your state? MN

If two people get married in minnesota and they request a certified copy of the divorce papers, and none are available - the party claims neither have been divorced and go ahead with the marriage, is this really a legal marriage? What are the consequences? thanks..

It depends - were both parties legally single at the time of the marriage?

yes they were legally single. one was never married, the other had a legal divorce. just that the marriage certificate reads that the one has never been divorced - which isn't true.

Guess again. One has never been divorced. Now which one would that be? Think hard.

Here's a hint. If you are never married can you ever be divorced?

guess I am not clear. on the marriage certificate it states that the individual that was divorced has not been divorced. It only states this because there was no certified copy of the divorce on hand therefore they lied and said - no I was never divorced? My question is, is this legal with there being a lie on the certificate.

So, WERE THEY DIVORCED? and don't tell me what you told the licensing authority. Was the party divorced at the time of the marriage?

The way I read it, both were legally entitled to marry, but the notation about prior marriages on the license was erroneous. Correct?

If that's the case, YES, the marriage should be legal.
