| Is he legally adjudicated the father? Did he sign the affidavit of paternity? If not then you have to serve him, establish paternity, and then get his permission to have the child's name changed. Or the court will decide and most likely the court will not allow you to change the child's name without dad's permission. If paternity is not established and you establish it, then you can petition the court for child support but don't be surprised if dad then asks for child custody once he is hit with anything.
