I am seeking legal separation from my spouse.
If he does not agree (by not signing papers) can I still get
my legal separation?
Thank you. |
My response:
Sign what papers?
He doesn't need to sign anything. You serve him, via the Sheriff, with the papers and then the court issues a hearing date to determine division of property, spousal support, allocation of parental rights and responsibilities, child support and companionship for any minor children. The parties remain married, but live separately. When a court grants the Legal Separation, each party must follow the specific orders of the court.
Just remember, you will still be married with a Legal Separation.
