1. Only you can decide whether you want a legal separation or not.
2. You can be held responsible for the unsecured debt if the account is held jointly.
3. You can return to the West Coast, returning with the children could be problematic for you. The father will likely contest the move and the courts will sympathize with Dad being geographically distanced from them.
4. The offer of help by your family is all well and good, but that, generally, is not a consideration in child custody matters.
5. Better off getting a legal separation for what? To protect yourself of any further financial debt incurred by your husband? Sure. Custody of your children, however, is a whole different matter.
