legal separation or not?

What is the name of your state? sd. I am nearing the point of separation and wondering if I should seek a legal separation. my spouse has trouble paying credit card bills on time and uses credit cards very excessively and i am worried about ending up with that responsibility. also, i am from the west coast area and would like to return there with the children, can he prohibit this? i will have to work to support us and my family is there and could help, is that an issue? in this case would i be better off to get a legal separation?

1. Only you can decide whether you want a legal separation or not.

2. You can be held responsible for the unsecured debt if the account is held jointly.

3. You can return to the West Coast, returning with the children could be problematic for you. The father will likely contest the move and the courts will sympathize with Dad being geographically distanced from them.

4. The offer of help by your family is all well and good, but that, generally, is not a consideration in child custody matters.

5. Better off getting a legal separation for what? To protect yourself of any further financial debt incurred by your husband? Sure. Custody of your children, however, is a whole different matter.
