My husband has been drinking and driving a lot of late. The vehicle he drives is titled to both of us and the loan is in my name. I have a fear that he will have an accident and hurt himself or someone. If this ever happened - what could happen to me, if anything?
Also, if we were separated but not divorced what would my liability to the situation be?
You assistance would be greatly appreciated. |

My response:
Buy two insurance policies - -
1. One Million vehicle liability insurance;
2. One Million life insurance on him.
Then, pray to God that he runs into a brick wall at 100 mph.
Problem solved.

I don't CARE if he doesn't like you hiding the keys, blocking his car with yours, or finding a way to get his car booted, in my opinion, anyone who lets another drive off drunk is also culpable. He'll like living with the inevitable consequences of his actions, like maybe plowing into a car containing a family with kids, even less.

All I really want is the legal aspect of the liability that I will shoulder should something happen. Thanks |

Hey, dumb lady - -
Buy the insurance policies like I said, and you won't HAVE to worry about your potential liabilities.
What's it going to take to get that through your thick skull?

As far as I know, Minnesota (?) is NOT a community property state, therefore, liability would be different from AZ (which IS a CM property state), however, this particular type of behavior (and concern for liability) is what inspired me to file for divorce.
As far as I know, separation would have no effect on liability. Do what IAAL says, the odds are much better than Vegas... |
