Living together 10 yrs


What is the name of your state (OHIO)?
My neighbor has lived with same man for 10 yrs. He pays no bills. One bill is in his name. The house is in her name. No children together. He is sleeping around, she wants him out. Can she obtain an eviction notice form, have it notorized and ask for a peace officer from local police department when she serves it to him, or does she have to go through a lawyer?

She has to follow landlord tenant law in Ohio. She doesn't need an attorney but she better read the law regarding evictions.

He has the same rights as a renter who is a month to month tenant and thats all, since they are under one roof then her best bet is to go get a post office box to use for short term , She can send a simple letter example , (keeping copy for her record, in safe place. ( todays date) then ( his name & address ) this is your notice to move out of ( address) by XXXX (time lines ohio state laws allow for month to month renters ) . Her name address and signature. send it to him via confirmed mail delivery & certified mail, certified he can ignore and it would be returned to the post office box so she can keep it safe so it doesnt magically vanish. Confirmed mail he could not ignore, BUT doing it 2 ways fair odds are the court would not permit him to claim he didnt get it. IF he doesnt move out at the end of the notice then she needs to go see the clerk of the court an tell them she needs to file a eviction based on tenant getting proper notice to get out and tenant refusing to leave. She will have some forms to fill out , pay fees and its best to have the sheriffs dept serve the court summons. IF she is gonna do this it really is best that she acts quickly and gets it into the mail so he can get it on thurs or friday.
