Marital Property rights


What is the name of your state (only U.S. law)? New York

I am currently married having marital problems and maybe heading for a divorce. We purchased 2 boats and 2 jet ski's during our marriage. All the items were in my husband's name. I just recently found out that he put the one of the boats, the cabin cruiser and the two jet ski's in a friends name What legal right does he have and if we do file for divorce, is this considered joint property anymore.

How long ago did he do that? If they were strictly in his name he has a right to do that but he no longer owns them. You can sue for divorce and -- depending on how long ago that he did that -- ask for him to be dinged for dissipation of marital property.

Marital Property Rights


It happened at the end of Nov. 2009.

So basically what you are saying is that I have no legal recourse, since it is in his name only.

Re-read what I said. File for divorce and ask that those items be credited to him due to dissipation. Did he sell the items? did he make money from the items?
