Marriage Just to Get Other Spouse's Health Insurance Coverage

Saw a TV episode of "Desperate Housewives" recently where one of the characters is getting married just so she can get health insurance from the other spouse's coverage, for an operation she needs. Husband to-be ("other spouse") character is an attorney on the show -- and in episode he says to her something like, "We're creating insurance fraud here. If we get caught we can both go to jail."

Is that right? Why is getting married *just* for picking up the health insurance coverage from the other spouse, illegal?

Texas or NM law, please.
