Married but not yet divorced...

What is the name of your state? What is the name of your state? What is the name of your state? Texas

My ex-husband and I were divorced November '03 and I remarried 2 weeks afterwards in Hawaii.I was then informed by the court in Los Angles where I was divorced that in fact I was not divorced because some paperwork had been filed incorrectly by the clerk. The reworking of the paperwork for my divorce became final in June of '04. My husband and I want to know do we need to remarry? or divorce and remarry? What are the consequences of not doing anything? Thanks.

Could have grave implications when you near retirement age and SS benefits and pensions etc.

The current marriage is a fraud and in the event that your husband dies or later decides he wants out, all he has to do is file for anullment. If he dies, you don't have a valid marriage so you inherit nothing.

Get the current marriage anulled then get married again.
