| I am wanting to find out if I am married by common law here in Texas. I was with my ex-partner and we had 2 children together. I had a son previously. We have since broken up but we were never married legally. He became disabled during our relationship and I remember SSI sending us some forms to fill out regarding the children, including my older son. Does this mean that I am legally married to him? The reason I ask is that I want to get married now and need to know if I have to get a divorce from my ex. Please Help!! |

| I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship. Texas A man and woman who want to establish a common-law marriage must sign a form provided by the county clerk. In addition, they must (1) agree to be married, (2) cohabit, and (3) represent to others that they are married. |
