DHS wants us to set up a miller trust account for my father-in-law. He is now in a nursing home and we are trying to get him on medicaid. What is a miller trust account and how do we set one up, do we need an attorney? Our bank has no idea what this is. Please help.

Try reposting your question on the Estate Planning & Elder Law forum. Hopefully they'll be able to help you. Also, remember to tell them in which state you reside.

Another option: Does he have a social worker assigned? If so, ask them. If not, feel free to call DHS and ask them to explain it. You could also run it by the nursing home administrator. They might be familiar with it.
