Mom died,father spent our trust money

What is the name of your state? What is the name of your state?California

My mother died when I was 8yrs old and she left my brother and I alot of money.We were supposed to get it when we turned 18.Well im 31 and father has none of the money and wont even help us with anything,Does my brother and I have a right to take him to court and ask for the money?Please help we are really not sure.

The first thing a judge is going to ask you is since you knew you were supposed to get this money when you turned 18, why did you wait so long? You may have implied your consent by waiting 13 years to do anything about this. And then, do you have any proof?
