| Mother-in-law problems What is the name of your state? Florida
We own our home with our mother-in-law (house and cottage). She put us on a quick claim deed in 2000 as she has been terminally ill since 1992. The mortgage is held by the origional owner of the property. We consider this property as our investment since we would own a home elsewhere had it not been for these curcumstances. We pay the mortgage, half of the insurance, upkeep of the houses and grounds, and have made improvements. These are some things she has done so far.
1. Remortage with a payout for an extra $60000 without our knowledge. She arrainged this with the mortgage holder and told us 6 months later. Since this mortgage was illegal because we didn't know about it, we were forced to have it rewritten. She went back to the mortgage holder's lawyer for the rewrite.
2. When it was time to sign the mortage, she gave us the document, but said she had misplaced the payment schedule. She told us it was a 30 year fixed. What she did not tell us was that it was an interest-only mortgage. The only place this appeared was in the schedule that she "misplaced". We found this out the second year when we were doing our taxes.
3. We are presently trying to get the house remortgaged with a bank. We are approved for everything except one: She has a lean on a house from the VA. Apparently there was an overpayment to her from her deceased husband's account. She ignored the VA, the collection agency. She now owes them $20,000. I guess she figured we could pay it when she dies.
4. She has multiply hospital bills. At one point she told us that she was told to ignore them by an attorney. She claims that she will get on a payment plan, but somehow I think she is lying.
This is my question: How do we protect our property (and ourselves) from her? |
