Motion to Quash Answer


What is the name of your state? NM
I've been divorced 13 years and have been in court several times as my ex sues to raise the child support. Each time she has a different attorney, each time I try to get it settled without a hearing and each time it goes to court. I represent myself as I always have to pay her attorney's fees and I can't afford attorneys for both of us. I drive a truck 48 states and it's not easy getting documents prepared and filed while on the road. I've been putting down the basics of what I want and sending it to my parent who prints it out and signs it on my behalf with my Power of Attorney and sends it to the court. This time her attorney has filed a Motion to Quash my Answer because it was signed in this way. They also ask that my parent be prevented from practicing law without a license! They also set up a hearing date of next Tuesday (July 1) giving me a week's notice. I'll make it but it'll be close. I think they're just trying to make it difficult for me but would like to know if there is anything to this.

There might be something to it. It's not simply a case of your parent signing for you, but a case of him/her preparing the papers for you. Which is, essentially, practicing law. Which s/he can't do.
