moving to another state

I am from Tennessee and moving to North Carolina. I have a 6yr old son from a past relationship. We were never married and custody was never established. The father is an illegal immigrant from mexico with no social or right to work. He has never paid child support. The courts said there is nothing they can do because he has no social and is illegal. I want to move to NC for a job. In moving would I be charged with kidnapping? What do I have to do to move and be legal? I plan to move in 1 week.
