Moving Children out of State

What is the name of your state (only U.S. law)? Texas
My husband and I live in Texas. We discussed and agreed to move to North Carolina in June 2009. I want to move earlier and start work and get everything set up before he comes. I need to move early for my health (all my family is in NC). My husband says he will call the police if I leave early because I am taking the children away from him. Can he do this? Do I have to stay until all of us move together? Or can I and the kids go now?

he can call but the police will laugh at him most likely. You can move to NC with the children. He can then IMMEDIATELY go to court in Texas and file for the children to be returned to Texas as well as to divorce you. If the children are ordered returned and you don't return, dad will basically be awarded full custody in the divorce -- I believe Texas calls it managing conservatorship.
