Are my Privacy Rights being violated?

What is the name of your state? California

I am 22 years old and I feel as if my privacy is being violated. Earlier this year in January, my mother told me that she hired a private investigator to follow me around, and I believe it started late last year (about Nov/Dec). My step-dad's nephew works for the police department and I don't remember his title, but he does criminal investigations, and my mother said that she asked for his help in this and I guess him and an investigator worked together. I asked her why and she said because she wants to "protect" me. I think this is completely ridiculous. Then yesterday she confronted me again, saying that they had transcripts of my cell phone conversations and logs of my text messages from my phone and that she read them. She said she was not allowed to take them home, but she did say some things that there would have been no way of her knowing unless she read the transcripts. But she did show me all the logs she's gotten (incoming/outgoing calls and text messages to and from what phone number). She also named additional places and things I did that she wouldn't have known unless someone was really watching me.

Is there a way to stop this? I didn't give anyone the right to divulge my information. I am not a criminal nor have I ever been. And I am not a minor so I don't think this is right. What can I do to stop letting the police or whomever is giving her this information? I know my mother would not stop if I asked her to, even though she may say she will, I have a feeling she will still secretly do it. Is there someone I can talk to at the police department or the courthouse? Thank you in advance for your help!

File a stalking complaint against the person who is following you.

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

The thing is I don't know exactly who it is. And the main problem is, isn't it illegal to get all this stuff about me without my consent?

How is she getting transcripts of your cell phone communications?

1. Who do you live with?

2. Who's name is the cell phone account in?

Yeah...Law enforcement would have to have a warrant to tap you phone.

I have no idea. She said she got it from the police. But like I said I haven't done any crimes, I don't do drugs, or smoke, or stay out late and apparently my step dad's nephew who is the crim investigator at the PD is helping her. Well that's what she told me.

I live at home, but it's because I'm helping out with family health problems, but I do pay my own bills, internet, gas, etc.

It's under her account because we are under a family plan with the phone company

Not really.
Lets list what you BELIEVE was obtained:

1) "my mother told me that she hired a private investigator to follow me around"
NOT ILLEGAL.

2) "I guess him and an investigator worked together."
Your guess is not illegal.

3) "yesterday she confronted me again, saying that they had transcripts of my cell phone conversations and logs of my text messages from my phone and that she read them."
Absent PROOF... such a claim is not illegal.

4) "She said she was not allowed to take them home, but she did say some things that there would have been no way of her knowing unless she read the transcripts."
Again... no PROOF that she had any 'secret' knowledge... just your assumption from vague claims. Might be just good guesses.

5) "But she did show me all the logs she's gotten (incoming/outgoing calls and text messages to and from what phone number)."
Again... not illegal. Your cell phone records are for sale from lots of sources.

6) "She also named additional places and things I did that she wouldn't have known unless someone was really watching me."
Again... just assumptions on your part. Might again be vague (or lucky) guesses.

So really what she did was get transcripts of HER cell phone records and texts of calls that go to HER phone.

Again...I don't think this is illegal either.

I would suggest you get your own cell phone... unless she's doing something illegal with the nephew, that would make it harder for her to obtain your records.

I know the claim isn't illegal, but isn't the following me and listening to my calls illegal?

She was pretty specific naming certain things that she wouldn't have known otherwise

Reading transcripts of calls and texts is not the same as listening to the calls. I wonder how she would be "listening" anyway. However, you must remember, it's her phone on her account, not yours and with that, I believe she can do what she wants, up to and including turning it off so you can't use it at all. Get your own phone.

If your really needing to make this all stop, then perhaps the best thing you can do is put miles inbetween the 2 of you, do you hear the call of the east ?? Mpls, Milwaukee, Chicago.

LOL FarmerJ.... but the weather is better in Cali (if I do say so myself). But all BS aside, I would have been out of there just about a week after I found out about all these shenanigans and given her back her cell phone. However, sometimes dependent children like to be dependant and decide when they want to be independant. Or want to be independant while still being dependant (that's a mouth full). In her case.... I hear the call. You think she'll answer it?
