Question

Name Change?


What is the name of your state? Florida

A friend of mine is trying to get a divorce from his wife, who were married in Oregon 10 years ago. His birth certficate carries one last name, and his social security card, military records and driver's license all carry an alias last name. If he were married under the alias, would that mean that legally he and his wife were never married?

I hope that the jumbled mess of words that I originally wrote made sense to someone other than me. I have had so many conflicting opinions on this question from friends and family, so I decided to post here and see what people who know what they are talking about (generally) think about it. I appreciate any and all replies.

He has been living for at least 10 years using a name other than that on his BC. That is his "legal" name. He's legally married, and needs to proceed as such.

True, he has been living for at least the last 10 years under his alias, but he never got his name legally changed. Does that make a difference??

Let's put it this way... if he now thinks that name isn't legal and he's therefore not married, he also has no driver's license, no military records, no social security number (and therefore no SS earnings).

He's aware of that, he is just super-curious as to if his marriage is valid. That would also mean that all 3 of his children were born out of wedlock.. Almost as if he never existed.

I have no doubt that his marriage is valid. If he's that concerned tho, he should speak with a local attorney.

Just curious to see if you are the only one who has any opinion or thoughts on this.. Very surprised that I have only gotten responses from one person. Usually I am bombarded with them! My friend has spoken to 2 lawyers, both gave him conflicting opinions on the situation. One said that he was never legally married, the other said he is legally married. Any thoughts??
