name change of minor


What is the name of your state? CT can i change the last name of my minor child to mine if the father doesn't want me to?

I don't know for sure, but I think a lot depends on whether his name is on the birth certificate, and whether you were married to the him.

Never married to him but name is on birth certificate.

You "can" change the name if it is contested (the other parent objects) but it is a much more costly and time-consuming process and doesn't always end the way you want it to.
As the father he MUST be notified of your petition to change the name (he will be served with a copy) and he is given a certain amount of time (ie 30 days) to answer your petition by responding to the court if he wants to contest it. If he doesn't contest it the judge will sign off but if he does file a contest to the change a hearing will be set. Both sides will state their case for and against the change and the judge will decide**************
