Question

Name Change (Minor)


What is the name of your state?What is the name of your state? Ohio Auglaize County.
Ok I actually have 2 questions.....First, I have just remarried and my two daughters would like to take my husbands last name. Their biological father lives not too far from us, there was never any child support ordered and I have not gone after it. He therefore doesn't pay any child support and hasn't for the past 10 years. He doesn't want to let my husband adopt the girls, even though he really dosen't play a role in the girls' lives. I have sole legal and physical custody of my girls and their biological father has none at all. My question is, is there a way for my girls to take my husbands last name?
Second question.....in the event that something happens to me and, God forbid, I die, is there a way to make sure their biological father doesn't end up with them? Can I make out a will stating that I want my husband to have custody of the girls and for them not to go to their biological father? Any advise on this would really be greatly appreciated. Thank you in advance.

1. You would have to file a petition for Change of Name of Minor, which a judge must sign to make it legal**************don't hold your breath on this one.

2. No. You can state your wishes in a will but, the the childs legal parent will be first in line for custody, unless unfitness is an issue.
