Question

Name Change with One Parent on Birth Certifcate


I live in North Carolina and want to change my daughter’s last name. I am the only parent on the Birth Certificate. My daughter currently has my maiden name. The biological parent pays child support but has never had contact with my daughter. I would send him papers to sign but he is not one to respond. Thus, I am wondering if there is a way to change her last name perhaps with only having to send him some type of notification?

Since your daughter has a legal father, he must be notified of any petition for a name change.

You should get a consult with a local attorney to find out how the notification must be done to make it legal.
