Im in California, I have a child from a previous
non-married realtionship, which no contact nor support has been made for the past 5 1/2 years. My son, is now 9 and has a faint memory of the biodad and asks of his whereabouts, and can he see him (i dont know where he is,and that is what i tell him). I am now married with 2 additional children with my husband, and naturally my son wants the same last name as ours. Bottom line: is there a procedure I can do that will allow my sons last name to be changed, without doing an adoption (so if my son demands a relationship with his biodad before 18, I want the biodad to pay for something, and not get off scott free.)If i let an adoption go through with my husband, and my son wants to see and know his biodad, who am I to deny my son his request. I just want a way that my child can have our name, but there still be a door open to sue the biodad for support (since he told me in the past, he wants a relationship but does not want to pay support.

I'm not sure if you will be able to do what you are asking as the father of the child must also agree to the name change.
