Ex wife has recently been convicted of dui(1st offense, misdemeanor) and recieved 2yrs. probation..for the same accident she has been indicted on 2 counts of child endangerment(1st offense,felony) , which goes to a grand jury and awaiting setting..question: how can i find the conditions of the probation and what can i expect from the state as far as punishment for the c.e.. I have also filed motion for change of custody..what are my chances of getting custody.Any advice would be helpful !! thank you

My response:

The chances of you gaining custody depend upon you, your stability, and your criminal history and record. Suffice it to say, your wife is definately "out of the loop" for consideration for being a custodial parent. She wiped herself out of that picture, and probably for life. She almost wiped her child "off the map" one time - - do you really think a court is going to give her a "second chance" to do that again ?

As for your other questions, put them on the criminal law board.

Seeing how im in texas and the courts are extremely biased towards the female persausion not matter how good of a father the xhusband is and how this is her first offenseshell will probably get slapped on the wrist for this.but i will not give up, i told when i divorced her that if she messes up i will take the kids, she was walking on a thin line then,know is is on a razors edge.so when shes on her probations i will be watching her every move knowing the state wontand i will report any violation of her probation conditions,because i am almost positive she will only get probation here in texas.thanx for your response anyway.
