In Need of avdice


What is the name of your state? Colorado.

My father just passed away. I am his only child. He had two step children. Their mother passed away on Mother's Day last year. She left no will. He left a handwritten will. He wanted the house sold, bills paid, & the remainder to be devided by 3. The stepchildren claim the house is theirs. I want to carry out my fathers wishes. Can I just push thru his wishes? His sister was named executor and she agree with me but doesn't know what to do. Neither one of us know what to do now that we have him laid to rest. Where do we start with the paperwork? Another question his last social security check and pension should go to me correct? Any advice would be greatly apprecited.

I would if it were an option. Very fixed income. I wouldn't be on a free advice forum if I could afford a lawyer. In a bad mood, had a bad day and confussed. I am haveing more questions asked than I am getting answers. It has only been a week, still not sure this is real, so sudden and out of left field. Just goes to show you. You never know what tomorrow will bring. You may lay down at night and never wake up. That is what happened to my dad.

There is an "Estates" and a "Wills and Probate" board on this website. Go to the main Q&A page to find them.

Whose name was on the house? If it was your fathers, then likely it would pass only to you. If it was his wifes, you have a problem. If both, likely all three of you will inherit.
