Question

need help!!


What is the name of your state (only U.S. law)? NJ

Married to an Australian Citizen but she forgot to get her divorced done after 8yrs of her previous marriage in another Country and she just received it a month ago after finding out that she needs to get it done before sponsoring me as a spouse to join her and the kids in Australia when she returned to Australia a year ago ....we have kids together 4yr old and 2yr old and both with her in Australia right now they were both US born

I just wanna know if our marriage in here is still legal or do we have to get divorce and get married again and does she needs to come back here to correct this mess

She...forgot to get divorced?!

No, your marriage will not be valid if she was not divorced when you actually did get married. I do have a question though -

When she took the children back to Australia, were you both aware that she had not actually been divorced?
